Understanding what is already in force, what will apply from August 2, 2026, and which deadlines have been redefined by the Digital Omnibus is the first step toward building an orderly, sustainable <strong>AI governance<\/strong> path that fits with a company&#8217;s existing processes.<\/p>\n<h2 class=\"text-text-100 mt-3 -mb-1 text-&#091;1.125rem&#093; font-bold\" dir=\"auto\" data-sourcepos=\"13:1-13:49;1055-1103\">Which AI Act obligations are already in force<\/h2>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"15:1-15:251;1105-1355\"><strong>Since February 2, 2025<\/strong>, the Regulation&#8217;s general provisions have applied, along with the requirement to ensure an adequate level of AI literacy for staff involved in using or managing AI systems, and the bans on practices considered unacceptable.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"17:1-17:95;1357-1451\">Under the conditions set out in <strong>Article 5 of the Regulation<\/strong>, prohibited practices include:<\/p>\n<ul class=\"&#091;li_&amp;&#093;:mb-0 &#091;li_&amp;&#093;:mt-1 &#091;li_&amp;&#093;:gap-1 &#091;&amp;:not(:last-child)_ul&#093;:pb-1 &#091;&amp;:not(:last-child)_ol&#093;:pb-1 list-disc flex flex-col gap-1 pl-8 mb-3\" dir=\"auto\" data-sourcepos=\"19:1-23:44;1453-1884\">\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"19:1-19:97;1453-1549\">the <strong>use of manipulative or deceptive techniques<\/strong> capable of distorting a person&#8217;s behavior;<\/li>\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"20:1-20:129;1550-1678\">the <strong>exploitation of vulnerabilities<\/strong> linked, for example, to age, disability, or specific social or economic circumstances;<\/li>\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"21:1-21:76;1679-1754\"><strong>social scoring systems<\/strong> that lead to harmful or unfavorable treatment;<\/li>\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"22:1-22:86;1755-1840\"><strong>emotion recognition<\/strong> in the workplace and in education, with limited exceptions;<\/li>\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"23:1-23:44;1841-1884\">other uses expressly listed in Article 5.<\/li>\n<\/ul>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"25:1-25:185;1886-2070\">Since <strong>August 2025<\/strong>, obligations have applied to providers of general-purpose AI models \u2014 the so-called GPAI models \u2014 including transparency and technical documentation requirements.<\/p>\n<h2 dir=\"auto\" data-sourcepos=\"27:1-27:73;2072-2144\"><img decoding=\"async\" class=\"wp-image-30496 size-full aligncenter\" src=\"https:\/\/res-group.eu\/wp-content\/uploads\/2026\/07\/Infografica-AI-Act-ENG.jpg\" alt=\"\" width=\"1200\" height=\"675\" srcset=\"https:\/\/res-group.eu\/wp-content\/uploads\/2026\/07\/Infografica-AI-Act-ENG-200x113.jpg 200w, https:\/\/res-group.eu\/wp-content\/uploads\/2026\/07\/Infografica-AI-Act-ENG-300x169.jpg 300w, https:\/\/res-group.eu\/wp-content\/uploads\/2026\/07\/Infografica-AI-Act-ENG-400x225.jpg 400w, https:\/\/res-group.eu\/wp-content\/uploads\/2026\/07\/Infografica-AI-Act-ENG-600x338.jpg 600w, https:\/\/res-group.eu\/wp-content\/uploads\/2026\/07\/Infografica-AI-Act-ENG-768x432.jpg 768w, https:\/\/res-group.eu\/wp-content\/uploads\/2026\/07\/Infografica-AI-Act-ENG-800x450.jpg 800w, https:\/\/res-group.eu\/wp-content\/uploads\/2026\/07\/Infografica-AI-Act-ENG-1024x576.jpg 1024w, https:\/\/res-group.eu\/wp-content\/uploads\/2026\/07\/Infografica-AI-Act-ENG.jpg 1200w\" sizes=\"(max-width: 1200px) 100vw, 1200px\" \/><\/h2>\n<h2 class=\"text-text-100 mt-3 -mb-1 text-&#091;1.125rem&#093; font-bold\" dir=\"auto\" data-sourcepos=\"27:1-27:73;2072-2144\">August 2, 2026: transparency obligations and the start of enforcement<\/h2>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"29:1-29:158;2146-2303\">The <strong>August 2, 2026<\/strong> deadline widens the scope of applicable rules and makes internal oversight of the AI tools used within a company a more pressing need.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"31:1-31:303;2305-2607\">The first area concerns the <strong>transparency obligations<\/strong> set out in Article 50 of the Regulation, which apply to systems that interact directly with people \u2014 such as chatbots and automated assistants \u2014 and to those that generate synthetic content: <em>text<\/em>, <em>images<\/em>, or <em>audio<\/em> produced with AI support.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"33:1-33:370;2609-2978\">On this point, the <strong>Digital Omnibus<\/strong> introduces an important operational clarification: for systems already placed on the market before August 2, 2026, the transition period granted to providers to comply with watermarking obligations is reduced from six to three months. As a result, the effective compliance deadline is not August 2, 2026, but <strong>December 2, 2026<\/strong>.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"35:1-35:344;2980-3323\">A second area concerns the full <strong>operability of the penalty system<\/strong>: from August 2026, national supervisory authorities are fully active and the penalties set out in the Regulation can be applied. In Italy, oversight of GPAI models is entrusted to the <a class=\"underline underline underline-offset-2 decoration-1 decoration-current\/40 hover:decoration-current focus:decoration-current\" href=\"https:\/\/www.acn.gov.it\/portale\/home\">National Cybersecurity Agency<\/a>, under Law 132\/2025.<\/p>\n<h2 class=\"text-text-100 mt-3 -mb-1 text-&#091;1.125rem&#093; font-bold\" dir=\"auto\" data-sourcepos=\"37:1-37:71;3325-3395\">Digital Omnibus and the AI Act: new deadlines for high-risk systems<\/h2>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"39:1-39:351;3397-3747\">On June 29, 2026, the Council of the European Union approved the <strong>Digital Omnibus<\/strong>, the package of amendments to the AI Act that redraws the deadlines for systems classified as high-risk. The text is awaiting publication in the EU Official Journal, after which it will enter into force three days later. The new dates set for high-risk systems are:<\/p>\n<ul class=\"&#091;li_&amp;&#093;:mb-0 &#091;li_&amp;&#093;:mt-1 &#091;li_&amp;&#093;:gap-1 &#091;&amp;:not(:last-child)_ul&#093;:pb-1 &#091;&amp;:not(:last-child)_ol&#093;:pb-1 list-disc flex flex-col gap-1 pl-8 mb-3\" dir=\"auto\" data-sourcepos=\"41:1-42:118;3749-3925\">\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"41:1-41:59;3749-3807\"><strong>December 2, 2027<\/strong> for standalone systems (Annex III);<\/li>\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"42:1-42:118;3808-3925\"><strong>August 2, 2028<\/strong> for systems integrated into products already regulated by sector-specific legislation (Annex I).<\/li>\n<\/ul>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"44:1-44:42;3927-3968\">The package also affects two other areas.<\/p>\n<ul class=\"&#091;li_&amp;&#093;:mb-0 &#091;li_&amp;&#093;:mt-1 &#091;li_&amp;&#093;:gap-1 &#091;&amp;:not(:last-child)_ul&#093;:pb-1 &#091;&amp;:not(:last-child)_ol&#093;:pb-1 list-disc flex flex-col gap-1 pl-8 mb-3\" dir=\"auto\" data-sourcepos=\"46:1-48:371;3970-4532\">\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"46:1-46:191;3970-4160\">The deadline for national authorities to set up <strong>regulatory sandboxes<\/strong> \u2014 testing environments for trialing AI systems before they reach the market \u2014 is pushed back to <strong>August 2, 2027<\/strong>.<\/li>\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"48:1-48:371;4162-4532\">In addition, AI systems embedded in machinery will no longer fall under the direct application of the AI Act; instead, they will be governed by the <strong>Machinery Regulation (EU) 2023\/1230<\/strong>. However, the Commission will need to update that regulation with AI-specific safety requirements equivalent to those of the AI Act, to avoid protection gaps during the transition.<\/li>\n<\/ul>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"50:1-50:564;4534-5097\">In any case, until the Digital Omnibus is published in the Official Journal, the original deadlines formally remain in force. Publication is expected before August 2026, with the stated aim of avoiding a situation where the original deadline takes effect before the legislative process is complete. This is a reasonable expectation, but not yet a legal certainty: <strong>anyone managing compliance within an organization should factor this in when planning<\/strong>, continuing to prepare as though the original deadline applies and treating the postponement as extra margin.<\/p>\n<h2 class=\"text-text-100 mt-3 -mb-1 text-&#091;1.125rem&#093; font-bold\" dir=\"auto\" data-sourcepos=\"52:1-52:52;5099-5150\">How to get AI governance started in your company<\/h2>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"54:1-54:320;5152-5471\">The postponements introduced by the Digital Omnibus spread the governance work out over time, without reducing its scope. The work of <strong>mapping<\/strong>, <strong>classification<\/strong>, and <strong>internal organization<\/strong> should start as soon as possible, since the quality of the process also depends on the consistency with which it is built.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"56:1-56:66;5473-5538\">This process can be broken down into a few steps, detailed below.<\/p>\n<h3 class=\"text-text-100 mt-2 -mb-1 text-base font-bold\" dir=\"auto\" data-sourcepos=\"58:1-58:14;5540-5553\">Inventory<\/h3>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"60:1-60:236;5555-5790\">The starting point is having a clear picture of what is actually running within the organization. Many companies use <strong><a class=\"underline underline underline-offset-2 decoration-1 decoration-current\/40 hover:decoration-current focus:decoration-current\" href=\"https:\/\/res-group.eu\/en\/article\/ai-adoption-enterprises-europe-italy\/\">AI tools without a structured inventory<\/a><\/strong>:<\/p>\n<ul class=\"&#091;li_&amp;&#093;:mb-0 &#091;li_&amp;&#093;:mt-1 &#091;li_&amp;&#093;:gap-1 &#091;&amp;:not(:last-child)_ul&#093;:pb-1 &#091;&amp;:not(:last-child)_ol&#093;:pb-1 list-disc flex flex-col gap-1 pl-8 mb-3\" dir=\"auto\" data-sourcepos=\"62:1-65:50;5792-5928\">\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"62:1-62:22;5792-5813\">writing assistants,<\/li>\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"63:1-63:35;5814-5848\">document classification systems,<\/li>\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"64:1-64:30;5849-5878\">predictive analytics tools,<\/li>\n<li class=\"font-claude-response-body whitespace-normal break-words pl-2\" data-sourcepos=\"65:1-65:50;5879-5928\">AI components embedded in third-party software.<\/li>\n<\/ul>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"67:1-67:342;5930-6271\">The Regulation distinguishes between <strong>providers<\/strong>, <strong>deployers<\/strong>, <strong>importers<\/strong>, and <strong>distributors<\/strong>, and the same organization can hold different roles depending on the system in question. Identifying the systems in use and clarifying the organization&#8217;s role with respect to each one is the prerequisite for any serious compliance effort.<\/p>\n<h3 class=\"text-text-100 mt-2 -mb-1 text-base font-bold\" dir=\"auto\" data-sourcepos=\"69:1-69:19;6273-6291\">Classification<\/h3>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"71:1-71:308;6293-6600\">The second step concerns <strong>risk-level classification<\/strong>, based on <strong>the potential impact on people, rights, safety, and essential services<\/strong>: a spam filter and an algorithm used in a personnel selection process don&#8217;t carry the same regulatory profile, and therefore don&#8217;t require the same level of oversight.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"73:1-73:189;6602-6790\">A technical-organizational classification exercise \u2014 without necessarily launching a formal legal assessment right away \u2014 makes it possible to set priorities and scope the work rationally.<\/p>\n<h3 class=\"text-text-100 mt-2 -mb-1 text-base font-bold\" dir=\"auto\" data-sourcepos=\"75:1-75:13;6792-6804\">Training<\/h3>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"77:1-77:470;6806-7275\">On the <strong>training<\/strong> side, the obligation to ensure an adequate level of AI literacy for people working with these tools is already in force. The required training must ensure that anyone using an AI system understands the tool, knows its limitations, and knows when human oversight is needed. For many organizations, this is also the quickest step to get moving, and it delivers positive effects on the day-to-day use of these tools, regardless of regulatory deadlines.<\/p>\n<h3 class=\"text-text-100 mt-2 -mb-1 text-base font-bold\" dir=\"auto\" data-sourcepos=\"79:1-79:24;7277-7300\">Compliance and GDPR<\/h3>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"81:1-81:369;7302-7670\">Finally, anyone processing personal data within their AI systems needs to treat <strong>AI compliance and GDPR<\/strong> as a single track. Assessing the legal basis, data minimization, purpose limitation, and, where necessary, a data protection impact assessment are all part of the same organizational design. Addressing them separately creates redundancies and, very often, gaps.<\/p>\n<h2 class=\"text-text-100 mt-3 -mb-1 text-&#091;1.125rem&#093; font-bold\" dir=\"auto\" data-sourcepos=\"83:1-83:65;7672-7736\">AI Act compliance: why it pays to start building the path now<\/h2>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"85:1-85:405;7738-8142\">Organizations that move their compliance work forward only in response to urgent deadlines rarely manage to build a sustainable AI governance structure over time. Starting the process as early as possible, on the other hand, means being able to <strong>build an accurate inventory<\/strong>, <strong>define roles and responsibilities<\/strong> with proper care, and face future deadlines with a system that&#8217;s already up and running.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\" dir=\"auto\" data-sourcepos=\"87:1-87:249;8144-8392\">The regulatory complexity of the AI Act is real, but it can be managed with the right method.
